Milito Labs provides an informational website and project inquiry channel. Any paid software, automation, or consulting work is governed by separate written agreements between you and Milito Labs, not by these terms alone.

You agree not to:

• Use the site in any unlawful manner or for any unlawful purpose.
• Attempt to gain unauthorized access to systems, accounts, or data.
• Interfere with or disrupt the site, servers, or networks connected to the site.
• Scrape, harvest, or collect data from the site without our prior written consent.
• Upload or transmit malware, spam, or harmful code.

The site and its content, including text, graphics, logos, and design, are owned by Milito Labs or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Milito Labs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Milito Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the site.

Our total liability for any claim arising out of or relating to these terms or the site will not exceed the greater of one hundred dollars ($100) or the amounts you paid Milito Labs for services in the twelve (12) months before the event giving rise to the claim.

You agree to indemnify and hold harmless Milito Labs and its owners, contractors, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the site or violation of these terms.

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Except for disputes that qualify for small claims court or for injunctive relief relating to intellectual property misuse, any dispute arising out of or relating to these terms or the site will be resolved by binding arbitration on an individual basis, not as a class or representative action.

Arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The seat and venue for arbitration will be El Paso County, Texas, unless the parties agree to a virtual hearing or another location permitted by the AAA rules.

You and Milito Labs each waive the right to a jury trial and to participate in a class action, class arbitration, or other representative proceeding.

You may opt out of this arbitration agreement within thirty (30) days of first accepting these terms by sending written notice to the contact email listed below. Your notice must include your name, the email address associated with your use of the site, and a clear statement that you opt out of arbitration.

We may update these Terms of Service from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the site after changes become effective constitutes acceptance of the revised terms.
